{"id":3628,"date":"2011-12-06T18:01:40","date_gmt":"2011-12-07T01:01:40","guid":{"rendered":"http:\/\/nocapx2020.info\/?p=3628"},"modified":"2011-12-06T18:33:40","modified_gmt":"2011-12-07T01:33:40","slug":"yesterdays-prehearing-conference-in-madison","status":"publish","type":"post","link":"https:\/\/nocapx2020.info\/?p=3628","title":{"rendered":"Yesterday&#8217;s Prehearing Conference in Madison"},"content":{"rendered":"<p><a href=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/12\/statecapitolmadisonwis.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3629\" title=\"statecapitolmadisonwis\" src=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/12\/statecapitolmadisonwis.jpg\" alt=\"statecapitolmadisonwis\" width=\"450\" height=\"286\" srcset=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/12\/statecapitolmadisonwis.jpg 450w, https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/12\/statecapitolmadisonwis-300x190.jpg 300w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\" \/><\/a><\/p>\n<p>Back from Madison, a long long day, I just don&#8217;t do mornings well, 4:45 a.m. sucks.\u00c2\u00a0 Anyway, here&#8217;s the Prehearing Order for the CapX 2020 Hampton-Rochester-LaCrosse transmission line, hot off the press:<\/p>\n<blockquote><p><a href=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/12\/05-ce-136-prehrg-conf-memo.pdf\">Prehearing Conference Memo &#8211; December 6, 2011<\/a><\/p><\/blockquote>\n<p>The most important part of this, well, the part that sticks out for me, is that the &#8220;technical&#8221; (evidentiary) hearing is at most one week long.\u00c2\u00a0 The Certificate of Need in Minnesota took 5 weeks, maybe more, and each routing proceeding took 2 weeks, and here we&#8217;re doing both in one week?\u00c2\u00a0 I just don&#8217;t see how that can be done.<\/p>\n<p>Next are public hearings, and that will be on March 13 and 14, 2012, in only two locations, with afternoon and evening sessions.<\/p>\n<p>And check this &#8212; there&#8217;s this point about cross-examination of witnesses, and the judge said &#8220;presenting a direct case on cross isn&#8217;t going to work.&#8221;\u00c2\u00a0 That was in a discussion of &#8220;At Hearing&#8221; point #4:<\/p>\n<blockquote><p><em>4. Limit cross-examination of a witness by the length and scope required to reasonably investigate matters with respect to the testimony of that witness. To investigate beyond these parameters requires the party to have followed the applicable pre-hearing process for compelling the witness to appear at hearing.<\/em><\/p><\/blockquote>\n<p>OK, so let&#8217;s look at the &#8220;pre-hearing process for compelling the witness to appear at hearing,&#8221; that&#8217;s Prehearing point #4 and 6a:<\/p>\n<blockquote><p><em>4. Any party who compels a witness to appear at hearing shall create a volume of written testimony for that witness in the form of either a deposition or interrogatory. This requirement shall not apply if the party receives consent of the other parties and Commission staff prior to the deadline to file such testimony.<\/em><\/p>\n<p><em> <\/em><em>6.a.
