{"id":4269,"date":"2012-07-23T05:42:36","date_gmt":"2012-07-23T12:42:36","guid":{"rendered":"http:\/\/nocapx2020.info\/?p=4269"},"modified":"2012-07-23T05:59:06","modified_gmt":"2012-07-23T12:59:06","slug":"ferc-says-xcel-gets-of-badger-coulee","status":"publish","type":"post","link":"https:\/\/nocapx2020.info\/?p=4269","title":{"rendered":"FERC says Xcel owns % of Badger-Coulee"},"content":{"rendered":"<p>American Transmission Company just got slapped upside the head by FERC in the Order that came out Friday.\u00c2\u00a0 ATC claimed that IT was the owner of Badger-Coulee, the extension of CapX 2020 transmission from La Crosse to Madison (dashed line):<\/p>\n<p><a href=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/05\/badgercoulee.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3128\" title=\"badgercoulee\" src=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2011\/05\/badgercoulee.jpg\" alt=\"badgercoulee\" width=\"271\" height=\"166\" \/><\/a><\/p>\n<p>It&#8217;s the part of CapX that we know is connected, it&#8217;s a part of CapX that the Minnesota PUC&#8217;s ALJ&#8217;s Heydinger (Certificate of Need) and Sheehy (Hampton-LaX routing in MN) wouldn&#8217;t let us address in the dockets even though it&#8217;s obviously part of the plan, always has been, and it was demonstrated in the Wisconsin PSC proceeding that Hampton-LaX doesn&#8217;t do anything noteworthy without Badger-Coulee&#8230; and so during that Wisconsin hearing, Xcel Energy finally admitted the &#8220;necessity&#8221; of Badger-Coulee to its CapX plans:<\/p>\n<p><a href=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2009\/04\/ex-13-capx2020-powerpoint-p-7-big-picture-map.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-645\" title=\"Hearing Ex. 13, Big Picture Map\" src=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2009\/04\/ex-13-capx2020-powerpoint-p-7-big-picture-map-1024x789.jpg\" alt=\"Hearing Ex. 13, Big Picture Map\" width=\"408\" height=\"313\" srcset=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2009\/04\/ex-13-capx2020-powerpoint-p-7-big-picture-map-1024x789.jpg 1024w, https:\/\/nocapx2020.info\/wp-content\/uploads\/2009\/04\/ex-13-capx2020-powerpoint-p-7-big-picture-map-300x231.jpg 300w\" sizes=\"auto, (max-width: 408px) 100vw, 408px\" \/><\/a><\/p>\n<p>So here&#8217;s what FERC had to say, that Xcel Energy wins, in technicolor:<\/p>\n<blockquote><p><a href=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2012\/07\/ordergrantingcomplaint_20120719-3027.pdf\">Order Granting Complaint (FERC&#8217;s language!)<\/a><\/p><\/blockquote>\n<blockquote><p><a href=\"https:\/\/nocapx2020.info\/wp-content\/uploads\/2012\/07\/orderstmtnorris20120719-4007.pdf\">Statement from FERC Chair Norris<\/a><\/p><\/blockquote>\n<p>Bottom line:<em><\/em><\/p>\n<blockquote><p><em>We \tdisagree with American Transmission\u00e2\u20ac\u2122s argument that MISO does not \thave the authority to require American Transmission to share the La \tCrosse-Madison Line with Xcel.  Under the Tariff, MISO is \tresponsible for approving a regional expansion plan that designates \tthe transmission owners responsible for particular facilities.<span style=\"text-decoration: none;\"><sup><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: small;\"><strong><a class=\"sdfootnoteanc\" name=\"sdfootnote1anc\" href=\"#sdfootnote1sym\"><sup>1<\/sup><\/a><\/strong><\/span><\/span><\/sup><\/span> In similar vein, Wisconsin Commission avers that Wisconsin state \tlaw controls the ownership of the La Crosse-Madison Line.  Although \twe do not dispute Wisconsin Commission\u00e2\u20ac\u2122s statement that a \tprospective builder must receive a CPCN in order to build \ttransmission facilities in Wisconsin, the issue before the \tCommission is whether the Transmission Owners Agreement requires \tAmerican Transmission and Xcel to share responsibility for the La \tCrosse-Madison Line and whether MISO has appropriately exercised its \tdesignation authority in a manner consistent with the Transmission \tOwners Agreement and the Tariff \u00e2\u20ac\u201c not whether a prospective \tbuilder must receive a CPCN in order to build transmission \tfacilities in Wisconsin.
