For purposes of an award of appraisal fees under section           <a href=\"https:\/\/www.revisor.leg.state.mn.us\/statutes?id=117.085#stat.117.085\">117.085<\/a>, the fees awarded may not exceed $500 for all types of property.<\/p>\n<\/blockquote>\n<p>That statute gives them unfair advantage when condemning land, and now that we&#8217;ve got CapX 2020 and Green Power Express, and all sorts of awful transmission ideas coming down the pike, it&#8217;s important that they not get an advantage, and it&#8217;s important that landowners have all their constitutional protections under law.<\/p>\n<p>Here&#8217;s the Text:<\/p>\n<blockquote>\n<h3><a href=\"https:\/\/www.revisor.leg.state.mn.us\/bin\/bldbill.php?bill=H1182.0.html&amp;session=ls86\"><span style=\"font-size: smaller; font-weight: bold;\">H.F. Minnesota Statutes 2008, section 117.225, is amended to read:<br \/>\n<var>1.7<\/var><strong> 117.225 EASEMENT DISCHARGE.<\/strong><br \/>\n<var>1.8<\/var> Whenever claiming that an easement acquired by condemnation is not being used<br \/>\n<var>1.9<\/var>f\u00c2\u00a0 or the purposes for which it was acquired, the underlying fee owner may apply to the<br \/>\n<var>1.10<\/var> district court of the county in which the land is situated for an order discharging the<br \/>\n<var>1.11<\/var> easement, upon such terms as are just and equitable. Due notice of said application shall<br \/>\n<var>1.12<\/var> be given to all interested parties.
