Stat. 117.189 &#8212; by exempting public service corporations from many eminent domain laws, it gives utilities unfair advantage over landowners, and takes away the constitutional rights of landowners.\u00c2\u00a0 It&#8217;s got to go!<\/p>\n<p><a href=\"https:\/\/www.revisor.leg.state.mn.us\/bin\/bldbill.php?bill=S1112.0.html&amp;session=ls86\">Senate File 1112<\/a> and <a href=\"https:\/\/www.revisor.leg.state.mn.us\/bin\/bldbill.php?bill=H1182.0.html&amp;session=ls86\">House File 1182<\/a> were introduced Monday and are on the way to Senate Judiciary and House Gov Ops.<\/p>\n<p>Here&#8217;s the bill &#8212; it&#8217;s the repealer at the end that&#8217;s important:<\/p>\n<p>1.1\u00c2\u00a0\u00c2\u00a0 A bill for an act<br \/>\n1.2\u00c2\u00a0\u00c2\u00a0 relating to eminent domain; repealing certain exemptions for public service<br \/>\n1.3\u00c2\u00a0\u00c2\u00a0 corporations;amending Minnesota Statutes 2008, section 117.225; repealing<br \/>\n1.4\u00c2\u00a0\u00c2\u00a0 Minnesota Statutes 2008, section 117.189.<br \/>\n1.5\u00c2\u00a0\u00c2\u00a0 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:<\/p>\n<p>1.6\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 Section 1. Minnesota Statutes 2008, section 117.225, is amended to read:<br \/>\n1.7\u00c2\u00a0\u00c2\u00a0 117.225 EASEMENT DISCHARGE.<br \/>\n1.8\u00c2\u00a0\u00c2\u00a0 Whenever claiming that an easement acquired by condemnation is not being used<br \/>\n1.9\u00c2\u00a0\u00c2\u00a0 for the purposes for which it was acquired, the underlying fee owner may apply to the<br \/>\n1.10\u00c2\u00a0 district court of the county in which the land is situated for an order discharging the<br \/>\n1.11\u00c2\u00a0 easement, upon such terms as are just and equitable. Due notice of said application shall<br \/>\n1.12\u00c2\u00a0 be given to all interested parties. <span style=\"text-decoration: line-through;\">Provided, however, this section shall not apply to<\/span><br \/>\n1.13\u00c2\u00a0 <span style=\"text-decoration: line-through;\">easements acquired by condemnation by a public service corporation now or hereafter<\/span><br \/>\n1.14\u00c2\u00a0 <span style=\"text-decoration: line-through;\">doing business in the state of Minnesota.<\/span><\/p>\n<p>1.15\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 Sec. 2.
