Contact Senate Judiciary Committee (651-296-1279)\u00c2\u00a0 and get on the list to testify — tell them your story, what condemnation means for you and why you need the protections other landowners get — why utilities aren’t special!<\/p>\n

SF1112<\/a> is the repeal of Minn. Stat. 117.189<\/a>, which gave utilities (public service corporations) an exemption from many of the landowner protections in Minnesota’s eminent domain law.\u00c2\u00a0 The bill will be heard in the House Energy Committee soon.<\/p>\n

Here’s the bill — it’s the repealer at the end that’s important:<\/p>\n

1.1\u00c2\u00a0\u00c2\u00a0 A bill for an act
\n1.2\u00c2\u00a0\u00c2\u00a0 relating to eminent domain; repealing certain exemptions for public service
\n1.3\u00c2\u00a0\u00c2\u00a0 corporations;amending Minnesota Statutes 2008, section 117.225; repealing
\n1.4\u00c2\u00a0\u00c2\u00a0 Minnesota Statutes 2008, section 117.189.
\n1.5\u00c2\u00a0\u00c2\u00a0 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:<\/p>\n

1.6\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 Section 1. Minnesota Statutes 2008, section 117.225, is amended to read:
\n1.7\u00c2\u00a0\u00c2\u00a0 117.225 EASEMENT DISCHARGE.
\n1.8\u00c2\u00a0\u00c2\u00a0 Whenever claiming that an easement acquired by condemnation is not being used
\n1.9\u00c2\u00a0\u00c2\u00a0 for the purposes for which it was acquired, the underlying fee owner may apply to the
\n1.10\u00c2\u00a0 district court of the county in which the land is situated for an order discharging the
\n1.11\u00c2\u00a0 easement, upon such terms as are just and equitable. Due notice of said application shall
\n1.12\u00c2\u00a0 be given to all interested parties. Provided, however, this section shall not apply to<\/span>
\n1.13\u00c2\u00a0 easements acquired by condemnation by a public service corporation now or hereafter<\/span>
\n1.14\u00c2\u00a0 doing business in the state of Minnesota.<\/span><\/p>\n

1.15\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 Sec. 2. REPEALER.
\n1.16\u00c2\u00a0 Minnesota Statutes 2008, section 117.189, is repealed.<\/p>\n

What to do?\u00c2\u00a0 Call or email every member<\/span> of the Senate Judiciary Committee and House Energy Committee and tell them to support SF1112<\/a> and HF1182!<\/strong><\/p>\n
