Yesterday, I posted about the limitation of public comment to 3 minutes at the beginning of the meeting in the Public Comment period. Today\u2019s post is about nuclear\u2026 as I go critical seeing what they\u2019ve done and are doing.<\/p>\n\n\n\n<p>A lot happened at the Red Wing City Council meeting on January 22, 2024. In addition to cutting public comment opportunities, there were two nuclear items, the first on the CONSENT AGENDA (yes, I\u2019m SHOUTING!) and the second in general business:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-28.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-28.png\" alt=\"\" class=\"wp-image-26334\"\/><\/a><\/figure>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-29.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-29.png\" alt=\"\" class=\"wp-image-26335\"\/><\/a><\/figure>\n\n\n\n<p>Here\u2019s the video of the meeting:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/redwingmn.portal.civicclerk.com\/event\/3040\/media\">January 22, 2024 Red Wing City Council meeting<\/a><\/h3>\n\n\n\n<p>Let\u2019s start with the first \u2013 10 F in the Consent Agenda \u2013 beginning on the video at 1:07:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-28-1.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-28-1.png\" alt=\"\" class=\"wp-image-26345\"\/><\/a><\/figure>\n\n\n\n<p>In the Staff Report from the Police Captain, Travis Bray, also Emergency Management Director, he states:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-30.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-30.png\" alt=\"\" class=\"wp-image-26337\"\/><\/a><\/figure>\n\n\n\n<p>And sure enough, there is no emergency plan in the packet, only discussion of it and a signature page.<\/p>\n\n\n\n<p><object data=\"https:\/\/legalectric.org\/f\/2024\/03\/20240122-10F_City-Council-Packet_PINGP-Emergency-Plan.pdf\" type=\"application\/pdf\"><\/object><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/20240122-10F_City-Council-Packet_PINGP-Emergency-Plan.pdf\">20240122-10F_City-Council-Packet_PINGP-Emergency-Plan<\/a><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/20240122-10F_City-Council-Packet_PINGP-Emergency-Plan.pdf\">Download<\/a><\/p>\n\n\n\n<p>On the first page of the Staff Report:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em><strong>The plan does detail certain steps relative to activation of the EOC and certain contacts that<br>must be made, however department and division heads still retain the responsibility for<br>determination of the appropriate level of response given the situation along with other demands<br>on their personnel by other events.<\/strong><\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Do department and division heads know enough about all things nuclear to \u201cretain the responsibility for<br>determination of the appropriate level of response\u2026?\u201d Shouldn\u2019t the NRC and state Emergency Management be the deciders on this, with advice from those on the ground?<\/p>\n\n\n\n<p>The Emergency Plan is to be reviewed and approved each year by:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-32.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-32.png\" alt=\"\" class=\"wp-image-26339\"\/><\/a><\/figure>\n\n\n\n<p>Travis Bray\u2019s Staff Report gives the Council two alternatives and a recommendation:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-31.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-31.png\" alt=\"\" class=\"wp-image-26338\"\/><\/a><\/figure>\n\n\n\n<p>\u2026 or\u2026<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-33.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-33.png\" alt=\"\" class=\"wp-image-26340\"\/><\/a><\/figure>\n\n\n\n<p>Travis Bray, Police Chief and Emergency Management Director for the City of Red Wing, was one of those to review and approve the plan. He was at the City Council meeting for the other agenda item, but this was on the consent agenda, and it was passed with zero discussion.<\/p>\n\n\n\n<p>Because \u201c[a] copy of the plan may be viewed at the EOC or the City of Red Wing Emergency manager\u2019s office,\u201d you can guess what I\u2019ll be doing someday soon. I\u2019m remembering the horrific\/hilarious Emergency Plan for Site P \u201cin Goodhue County,\u201d the dry cask storage facility proposed in Florence Township.<\/p>\n\n\n\n<p>Here\u2019s the NRC on <strong><a href=\"https:\/\/www.nrc.gov\/about-nrc\/emerg-preparedness\/about-emerg-preparedness\/federal-state-local.html\">\u201cFederal, State, Tribal, and Local Responsibilities\u201d<\/a><\/strong> in nuclear emergency.<\/p>\n\n\n\n<p>Click here for the Prairie Island Nuclear Generating Plant (PINGP) <strong><a href=\"https:\/\/www.nrc.gov\/docs\/ML1622\/ML16223A768.pdf\">Emergency Plan test and Final Action Report from 2016<\/a><\/strong>!<\/p>\n\n\n\n<p>+++++++++++++++++++++++++<strong>++++++++++<\/strong><\/p>\n\n\n\n<p>And back to the video of the January 22, 2024 meeting:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/redwingmn.portal.civicclerk.com\/event\/3040\/media\">January 22, 2024 Red Wing City Council meeting<\/a><\/h3>\n\n\n\n<p>Moving on to Agenda item 11.C.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-29.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-29.png\" alt=\"\" class=\"wp-image-26335\"\/><\/a><\/figure>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-34.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-34-1024x562.png\" alt=\"\" class=\"wp-image-26343\"\/><\/a><\/figure>\n\n\n\n<p>Xcel Energy wants to \u201cdonate\u201d the 33 emergency warning sirens and donate the costs of operation and maintenance to Red Wing. Great idea\u2026 Here\u2019s the packet for 11.C with all the details we have:<\/p>\n\n\n\n<p><object data=\"https:\/\/legalectric.org\/f\/2024\/03\/20240122-11_City-Council-Parket_Emergency-Sirens.pdf\" type=\"application\/pdf\"><\/object><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/20240122-11_City-Council-Parket_Emergency-Sirens.pdf\">20240122-11_City-Council-Packet_Emergency-Sirens<\/a><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/20240122-11_City-Council-Parket_Emergency-Sirens.pdf\">Download<\/a><\/p>\n\n\n\n<p>The Council was told that the Emergency Plan was essentially changed\u2026 but wait\u2026<\/p>\n\n\n\n<p><object data=\"https:\/\/legalectric.org\/f\/2024\/03\/LICENS1.pdf\" type=\"application\/pdf\"><\/object><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/LICENS1.pdf\">LICENS1<\/a><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/LICENS1.pdf\">Download<\/a><\/p>\n\n\n\n<p>Slide 5 says that Xcel Plans to decommission all outdoor sirens:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-35.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-35-1024x574.png\" alt=\"\" class=\"wp-image-26347\"\/><\/a><\/figure>\n\n\n\n<p>Slide 7 notes that \u201cthe State of MN has agreed to be the responsible party\u2026\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/legalectric.org\/f\/2024\/03\/image-36.png\"><img decoding=\"async\" src=\"https:\/\/legalectric.org\/f\/2024\/03\/image-36-1024x579.png\" alt=\"\" class=\"wp-image-26348\"\/><\/a><\/figure>\n\n\n\n<p>I have a few very logical questions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What jurisdiction currently has responsibility for emergency alerts?<\/li>\n\n\n\n<li>Cite the NRC regulations for Emergency Warning Systems, including sirens.<\/li>\n\n\n\n<li>\u201cState of MN has agreed\u2026\u201d Who? What? Where? Why? When? Produce the agreement.<\/li>\n\n\n\n<li>Were the affected Prairie Island Nuclear Generating Plant and Monticello Nuclear Generating Plant host communities involved in negotiating this agreement?<\/li>\n\n\n\n<li>Emergency sirens owned and maintained are a cost of doing business \u2014 why are they shifting this cost to us?<\/li>\n\n\n\n<li>If \u201cdonated\u201d they\u2019d get the benefit of being relieved of that cost, PLUS would likely receive a tax deduction for this \u201cdonation.\u201d<\/li>\n<\/ul>\n\n\n\n<p>Chief Bray is supposed to come back to the Council with more information and a recommendation.<\/p>\n\n\n\n<p>Soooooooo, will try to keep an eye out for this. It\u2019s NOT on the March 11, 2024 agenda.<\/p>\n\n\n\n<p>p.s.
