Prehearing Conference – CapX 2020 Fargo-St. Cloud Route
Attention all potential intervenors in the CapX 2020 transmission line docket for the Fargo-St. Cloud route. The first Prehearing Conference is next week, and if you’re thinking of intervening, it’s important that you attend.

The CapX 2020 Fargo-St. Cloud transmission routing docket is moving forward.

Beverly Heydinger is the Administrative Law Judge for this docket too, she handled the MinnCan pipeline, CapX 2020 Certificate of Need and CapX 2020 St. Cloud to Monticello route, and Hiawatha Project. She has a habit of requiring that Intervenors submit testimony and attend all public and evidentiary hearings (nothing in the rules says that’s necessary, although I’ve attend most public meetings of most proceedings I’ve been involved in, no other intervenors have!) and has also tried to boot intervenors out if they do not submit testimony, or attend all hearings.

In the Hiawatha Project she required that Intervenors submit testimony declaring their preferred route! That PRESUMES need!!! Not one of the many intervenors objected. I filed a Motion to have her booted off the case (ANY person may file such a motion at least 5 days prior to the start of the hearing) for bias, the PRESUMPTION of need, which went over like a lead balloon, but hey, it’s in the record! See: Hiawatha Project – oh well…
We’ll see what she does here. Be alert!!
Remember — Prehearing Conference May 18 — be there or be square — the Notice said that so far, no one has Intervened… NOT a good sign. So saddle up and head on out! Join the party at the Not So OK Corrall!
